Terms of Service

Welcome to Benjar. These Terms of Service ("Terms") govern your access to and use of the Benjar platform, website (benjar.org), dashboard (app.benjar.org), and API services (collectively, the "Service") operated by Benjar ("we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Benjar is a credit-based data API platform that provides developers and teams with access to structured data APIs. Users subscribe to monthly plans, receive API credits, and consume credits when making API calls. The Service returns structured JSON data from publicly available sources.

2. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials and API keys
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Plans, Credits & Billing

3.1 Subscription Plans

Benjar offers monthly subscription plans. Each plan includes a set number of API credits per billing cycle. Current plans and pricing are listed on our pricing page. We reserve the right to modify pricing with 30 days' notice.

3.2 Credits

  • Credits are allocated at the start of each billing cycle
  • Each API call deducts a stated number of credits based on the endpoint
  • Unused credits expire at the end of each billing cycle and do not roll over
  • Credits are non-transferable and have no cash value

3.3 Overage

Paid plans may include overage billing. When enabled, additional API calls beyond your plan's credit allotment are billed at the per-credit overage rate specified in your plan. The Free plan has a hard cap — no overage is permitted.

3.4 Payment Processing

All payments are processed securely by our Merchant of Record, Dodo Payments. By making a purchase, you also agree to Dodo Payments' Terms of Service. We do not store your full credit card details.

3.5 Taxes

All prices are exclusive of applicable taxes. Dodo Payments, as our Merchant of Record, will calculate and collect any applicable sales tax, VAT, or GST based on your jurisdiction.

4. Cancellation & Downgrades

You may cancel your subscription at any time from your dashboard. Upon cancellation:

  • Your plan remains active until the end of the current billing period
  • You retain access to your remaining credits until they expire at period end
  • No further charges will be made after the current period
  • Your account reverts to the Free plan at the end of the billing cycle

Plan downgrades take effect at the end of the current billing cycle. You can cancel a pending downgrade before it takes effect.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Use the Service to violate any applicable law or regulation
  • Attempt to circumvent rate limits, credit limits, or security measures
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Share your API key with unauthorised third parties
  • Use the Service to harass, defame, or harm any person or entity
  • Resell access to the API without our prior written consent
  • Use automated tools to create multiple free accounts to circumvent credit limits

We reserve the right to suspend or terminate access for violations of this section without prior notice.

6. Intellectual Property

All content, design, trademarks, logos, and software comprising the Service are owned by Benjar and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written permission.

Data returned by the API is sourced from publicly available information. We do not claim ownership of the underlying data. You are responsible for ensuring your use of the data complies with all applicable laws and the terms of the original data sources.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Service Availability & Modifications

We strive to maintain 99% uptime but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes that affect your subscription.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied
  • We do not warrant that the data returned by APIs will be accurate, complete, or current
  • In no event shall Benjar be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless Benjar, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

12. Force Majeure

Benjar shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or service disruptions by third-party providers.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the dashboard at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.
